01. ACCEPTANCE OF GENERAL TERMS AND CONDITIONS
All orders for publications sold on the apur.org website require the purchaser’s unconditional acceptance of these General Conditions of Sale. By placing his order, the purchaser acknowledges that he is fully aware of these General Conditions of Sale and that he accepts them unconditionally.
Most of the products on sale in the website shop apur.org are available immediately.
If, when an order has been placed, the articles prove to be temporarily unavailable (out-of-stock, in re-print, imports etc.) the Apur will immediately inform the purchaser by email, giving him the option of either waiting or cancelling his order.
If the products prove to be permanently unavailable (out of print, works not republished, etc.) the Apur will automatically cancel the order and inform the purchaser by email.
In this event, the payment made by the purchaser will be re-credited to the Credit Card used for the initial payment or via PAYPAL.
The photographs illustrating the products are not contractual. The Apur cannot be held liable for any errors in photos or captions or for any discrepancies between these photos and the products delivered.
The prices of products sold on the apur.org website are in Euros and are inclusive of VAT but do not include delivery charges.
The price indicated in the order confirmation is a final price including taxes and VAT for France and EEC countries. This price includes the price of the product and delivery. The Apur does not charge its customers for handling and packaging.
The books are sold in strict accordance with the Lang law of 10th August 1981: the prices fixed by the Editor are inclusive of tax.
The Apur may (within the limits of the Law of 10th August 2005) propose reductions corresponding to a maximum of 5% of the listed price. These will be clearly indicated on the website.
All orders, irrespective of their origin, shall be invoiced and payable in Euros.
Products are dispatched on reception of payment, with the exception of book retailers who are registered as customers in the space provided.
The products remain the property of the Apur until payment by the customer in full of the price, together with interest and any ancillary charges.
Any customs duties or import taxes that may result from an order placed abroad shall be borne solely by the purchaser and the Apur cannot be held liable for any declaration or payment.
Payment on line may be made either by Credit Card or via PAYPAL (the number of the card and validity date are to be indicated and also possibly the crytogram).
The PAYPAL payment system, a secure on-line payment service provider, secures the payments in several ways:
- Sent data encryption: using the “Secure Sockets Layer” (SSL) technology, information on the Credit Card is encrypted by the purchaser’s computer before being sent to the PAYPAL server.
- No storing of confidential information: information relating to the credit card (name, type of card, number and expiry date) is sent directly to the PAYPAL server. This checks the information provided with the appropriate payment centre (Carte Bleue or Visa) then validates or refuses the transaction without saving any confidential information.
The Apur cannot be held responsible for any malfunctions occurring via PAYPAL when making a payment or for any breach of confidentiality that may result in the piracy of banking information submitted.
The Apur is never informed of any banking information, and such information is never recorded.
In accordance with the Cnil (article 34 of the Data Protection Act of the 6th January 1978), the Apur, via the shop and the apur.org website, undertakes not to divulge or pass on any personal information concerning the purchasers.
The Apur may establish a list of customers, in compliance with the Data Protection Act. In such case, the customer’s agreement is required before he is included in this database. Book retailers, must be registered in this list to benefit from the trade discount given on their order
Unless specified by the customer when placing his order, delivery will be made to the address indicated at the time of order. It is possible for book retailers to pick up their orders from the Apur free-of-charge.
Delivery times include the time necessary to prepare the package (as given on the site in the section Delivery Costs and Delivery Times) and the delivery time.
The time indicated is 6 working days. The Apur is not liable for any delays in this schedule.
In the same way, the Apur shall not be liable for any delays in delivery or stock shortage at the publisher or the supplier.
In order to ensure maximum security in the delivery of items:
- In France, deliveries are sent by the French postal service or by “Colissimo Suivi”
- In EEC countries, deliveries are sent by the French postal service or by “Colissimo Suivi Europe”.
- Deliveries in countries outside the EEC are sent by international postal services.
Any delay shall not entitle the purchaser to claim any damages or interest from the Apur, but only, in certain cases, from the postal services or forwarding companies.
Pursuant to articles L 121.16 and in accordance with the French Consumer Code, the purchaser has a 7-day “cooling-off period”, dating from receipt of the order, during which he may return all or part of his order without any justification.
When the 7-day period expires on a Saturday, a Sunday or an public holiday, it is extended until the next working day.
The purchase must be returned in its original packaging, by recorded delivery with acknowledgement of receipt and with the corresponding invoice to:

Delivery costs (sending and return) will, in this case, be the responsibility of the purchaser.
On reception of the returned purchase, the Apur will verify the good condition of the product returned and either credit the bank account of the purchaser with the amount of the transaction, or send him a cheque in Euros for the amount of the order (ancillary costs being the responsibility of the customer) within a one-month period.
If the product has been damaged or soiled, the Apur reserves the right to refuse the return.
At the end of this 7-day period, the products delivered will be considered to be in conformity with the order and accepted by the purchaser.
The intrinsic value of the products shall not be questioned and the customer is solely responsible for his choice of products.
The articles provided by the Apur are new and guaranteed against any defects.
They are identical to those sold in bookshops in partnership with the Apur.
If an article should be defective or noncompliant, the Apur undertakes to exchange it or reimburse the cost, provided that it is returned by recorded delivery with acknowledgement of receipt in its original package including the corresponding invoice and within 7 days of receiving the package to:

The Apur accepts no liability in the event of incompatibility between the products ordered and the legislation of the country in which the customer lives.
09. RIGHT OF REPRODUCTION
All texts, commentaries, articles, illustrations and images found in the on-line shop are the exclusive property of the Apur and are protected by copyright worldwide.
In this respect and in accordance with the provisions of the Intellectual Property Code, only private representations held exclusively within the family circle are authorised and copies or reproductions are strictly reserved for the private use of the copyist and not intended for a collective use.
Without prior authorization from the Apur, any other use constitutes piracy and is sanctioned in accordance with the Intellectual Property Code.
These General Conditions of Sale are governed by French Law. The Paris Law Courts have jurisdiction to settle any disputes.
