Press release - 23rd January 2013 – Apur won their appeal and is exempt from penalty

The decision made by the Paris Magistrates' Court - Tribunal d'instance de Paris –on 22nd  January 2013, pronounced its verdict on the appeal, exempting from penalty Apur (legal person) and Francis Rol-Tanguy (natural person), Director of Apur at the time of the events which concerned hours worked daily and weekly exceeding the maximum number permitted, during the year 2010. The decision of the court renders null the heavy penalty of fines announced at the first hearing (222,000 Euros for Apur, 50,000 Euros for Francis Rol-Tanguy).

This decision takes into consideration the efforts made, since the verdict reached at the first hearing,  by the management, the  personnel and the trade unions permitting a schedule to be drawn up and measures taken to regularise the situation through calm and responsible dialogue.
As a reminder of the circumstances concerning the fines for non payment of hours worked overtime, the magistrate -juge de proximité- reached the verdict on 15th  February 2012 rendering Apur and Mr Rol-Tanguy exempt from any penalty, thus taking into account the work carried out and the commitment of all the personnel to regularise the situation which had existed since 1999. Therefore on two occasions the court pronounced Apur and Francis Rol-Tanguy exempt from penalty.
